The object of the company is to provide data-backed consulting services for doctors” and pharmacy professional associations, university research and the pharmaceutical industry. Data collection, processing and use is carried out to fulfil the purposes specified above.
Description of the Group of Persons Affected and the Relevant Data and Data Categories:
Personal data is collected, processed and used essentially on the following groups insofar as they are natural persons:
- Customers, leads, prospects: address and contact data, contract and payment terms
- Suppliers, service providers, co-operation partners: address and contact data, contract and payment terms
- Doctors, pharmacies and other health service providers: address data, data on medical specialisation, practice information, results of target group definitions, other data provided by customers to fulfil the purposes cited under 4
- Employees, former employees, applicants: address and contact data, contract information
Recipients or Categories of Recipients to which the Data may be Disclosed:
Public organisations where legal provisions that are in place have priority, customers and cooperating partners - in anonymised form - for the fulfilment of the purposes defined under point 4.
Regulated Deadlines for the Deletion of the Data:
The legislation has set out various obligations and deadlines relating to the retention of records. Upon expiry of these deadlines, the relevant data is deleted if it is no longer required to execute the contract or for business purposes, providing it is necessary based on statutory requirements.
- § 147 German Tax Code, § 257 German Commercial Code: 6 years (e.g. books, drawings, inventories, status reports, trade/commercial correspondence, documents of relevance for tax purposes), 10 years (e.g. annual accounts, opening balance sheet, booking documents),
- § 66 Tax Advisory Act: 10 years (e.g. reference files and relevant information)
- § 35 Federal Data Protection Act: immediate deletion (e.g. stored data that is no longer required or prohibited)
- Under pharmafakt’s general terms and conditions, project-related results and data will be deleted 6 weeks after the end of the project.
Planned Data Transfer to Third Countries:
A transfer to third countries is not currently planned. If data transfer to third countries should be necessary in exceptional circumstances, it will be effected only in line with the statutory permissibility regulations pursuant to §§ 4b and 4c of the Federal Data Protection Act.
